Child Sick Days in Germany: Pay, Form 21, and Quotas

Your child wakes up with a fever, Kita closes the door, and your calendar still shows a full workday. In Germany you are not expected to invent a “personal day” or burn vacation for every stomach bug. Working parents get a statutory right to stay home with a sick child, and often a wage-replacement benefit called Kinderkrankengeld.
The catch is the two-track system. Sometimes the employer still pays full salary. More often your contract has switched the cost to public health insurance (Gesetzliche Krankenversicherung, GKV), which means unpaid leave from work plus a claim to the Krankenkasse. Who pays: § 616 BGB or § 45 SGB V
Two statutes sit next to each other.
Section 616 BGB. In theory, if a short personal emergency stops you working (including caring for an acutely ill child), the employer keeps paying normal salary for a brief period. Most modern contracts and many collective agreements (Tarifverträge) exclude Section 616. If yours does, ignore the textbook promise of paid special leave and use the social-code route instead. Read the Ausschluss wording in your contract once, before the first fever season.
Section 45 SGB V. When Section 616 is excluded or already used up, you get an enforceable right to unpaid leave (unbezahlte Freistellung) and Kinderkrankengeld from your GKV fund. Your employer must release you when you present a valid medical certificate. They cannot veto the leave, reject the absence because of a deadline, or force you to spend annual holiday (Erholungsurlaub) instead, even if you could open a laptop at home.
If Section 616 is still active for you, the employer pays full salary for covered days and Kinderkrankengeld usually does not run in parallel for the same paid period. If it is excluded, plan on Krankenkasse pay, not a full payslip.
How many days you get (2024–2026)
Parliament raised the yearly quotas and kept the higher figures through 2026. Baseline law was lower (10 / 25 days per parent, or 20 / 50 for single parents); treat the table below as the current temporary rule set.

Funds check single-parent status carefully. You generally need sole custody, or you live alone with the child without another caregiving adult in the household. Expect a declaration and sometimes a registration certificate (Meldebescheinigung).
You need all of these for Kinderkrankengeld under Section 45:
- Child under 12 (no age cap if the child has a certified disability or chronic condition that needs continuous care)
- You and the child are both in statutory GKV
- A doctor certifies that the child needs continuous supervision or care so you cannot work
- Nobody else in the household can take over that day
Federal civil servants (Beamte) sit under the Special Leave Ordinance (Sonderurlaubsverordnung), not SGB V. In 2026 they typically get paid special leave with adjusted day counts (often up to 13 / 30, or 26 / 60 if single-parent). Confirm with your personnel office; the rest of this guide targets GKV employees.

It replaces lost wages. It is not full net pay for high earners.
- Default rate: 90% of the net pay you lost for those days (ausgefallenes Nettoarbeitsentgelt)
- 100% of lost net if you received contributory one-off payments (Einmalzahlungen) such as Christmas bonus, holiday pay, or a performance bonus in the 12 months before the claim
- Hard daily gross cap in 2026: €135.63 per calendar day (tied to the social-security contribution ceiling)
- The fund then deducts employee shares for pension (
9.3%), unemployment (1.3%), and long-term care (~1.8%, varies). You stay contribution-free for health insurance while on the benefit

If your daily net is well above the cap, budget for a gap. Self-employed people in voluntary GKV only get Kinderkrankengeld if their tariff includes sick-pay entitlement (Krankengeld). The daily rate is then often 70% of the contribution income base, still capped at €135.63.
What to do on day one
- Tell work early. Email or HR portal before start time if you can. Say the child is ill, you need care leave under Section 45 SGB V, and give a realistic end date. Say whether you are fully offline or can do a short async handover later. Label it unpaid child sick leave, not your own Arbeitsunfähigkeit, so payroll codes it correctly.
- Get medical proof. Call the paediatrician (Kinderarzt). Since 1 July 2024, practices can issue a child sick note by phone if the child is already known to the practice, a phone assessment is medically OK, and the note covers at most 5 calendar days. Longer illness needs an in-person exam.
- Complete Form 21 (Kinderkrankenschein). Official title: Ärztliche Bescheinigung für den Bezug von Krankengeld bei Erkrankung eines Kindes. Section A is the doctor (child data, diagnosis, care dates). Section B is you: tax ID, insurance numbers, employer, IBAN, statement that no other household member can care, and single-parent status if relevant.
- Send it in and let payroll talk to the fund. Upload Form 21 in your Krankenkasse app. The fund requests wage data from your employer through the electronic earnings-replacement exchange (DTA EEL). After payroll answers, the fund pays into your IBAN.
Set up the app before flu season. The first fever at 6:40 is a bad moment to reset a password.
Your rights vs how managers actually react
The leave is legally protected. How it feels inside a company still depends on team size, coverage culture, and how often you disappear at short notice. GKV pays the wage replacement; it does not replace you on a client call or a two-person ops shift.
A few daycare bugs are normal. One or two unscheduled days when a toddler brings something home rarely becomes a story. Maxing the full statutory quota every year, year after year, can create quieter career friction: fewer time-critical projects, slower leadership tracks, colleagues who remember who always absorbs the gap. That is not a legal penalty. It is how some workplaces ration trust.
Small teams feel it more. Startups, client-facing roles, and coverage-dependent desks pass the load to whoever is still online. Your absence is lawful; their overtime is still real. Clear Day-1 updates and partner alternating help more than apologising for using a statutory right.
Probation is the sharp edge. During the first six months (Probezeit), employers can usually end the contract without a KSchG social justification. Heavy early use of Kinderkrankentage can look like a reliability risk to cautious managers, even when every day was medically justified. If you can, share days with a partner during probation, keep communication crisp, and know the dismissal rules in Your Rights at Work in Germany. Do not skip care your child needs; do not assume Probezeit is culturally risk-free either.
Reduce friction without giving up the right:
- Alternate with your partner so one employer does not carry every fever week.
- On Day 1, give a realistic timeline and say if you can handle urgent async handovers in quiet moments, or if you are fully unreachable.
- Mild illness or recovery days: if the child does not need constant active care, ask whether flexible or mobile work (Mobiles Arbeiten) for part of the day is enough. Save a full Kinderkrankentag for days when care really blocks work. When active care is required, home office does not cancel your Section 45 right (see below).
Edge cases that trip people up
Hospital co-admission. If you are admitted with the child, Kinderkrankengeld can run for the whole medically necessary stay with no annual day cap, and those days do not eat your normal 15 / 30 quota. For children 8 or under, parental co-admission is usually presumed; ages 9–11 need an explicit medical statement that you must stay.
Home office does not cancel the right. If the child needs active care, you may take unpaid leave and claim the benefit even when your job is remote-capable. Your employer cannot insist you “just work from home with a sick toddler.” Flexible home work is only a substitute when care demand is light enough that you can still do the job.
Sharing days between parents. Unused days do not auto-transfer. A transfer under Section 45 needs the first parent’s quota empty, the second parent’s employer consent for extra unpaid leave, and both funds informed. The employer may refuse for operational reasons. Alternating from the first illness is usually easier than asking for a formal transfer later.
PKV mix-ups. Kinderkrankengeld needs both you and the child in GKV.

If the child is privately insured (common when one high-earning spouse is in PKV) and Section 616 is excluded, you may still get unpaid time off, but no GKV child-sick pay unless a private add-on covers it.
Partial days. Leave mid-shift after Kita calls and you can claim Kinderkrankengeld for the unpaid hours left. That still burns one full day of your annual quota. Flex time (Gleitzeit) is often smarter for a two-hour dash.
Tax. The benefit is tax-free, but it sits under the progression clause (Progressionsvorbehalt, Section 32b EStG). It raises the tax rate on your other income. Over €410 of wage-replacement benefits in a year usually forces an income tax return, which can mean a small back payment. Keep the fund’s annual statements (Leistungsnachweise).
A short checklist for working parents
- Check whether your contract excludes Section 616 BGB
- Know your 2026 quotas (15 / 35, or 30 / 70 if single-parent) and that the expansion is currently timed through end of 2026
- Install the GKV app and save your paediatrician’s phone number
- Alternate leave with your partner early in the year; transfers need employer yes
- During Probezeit, be extra deliberate about Day-1 communication and day-sharing
- Use flex or mobile work only when the child does not need constant active care; otherwise claim the day
- High earners: model the €135.63 daily gross cap
- Archive Leistungsnachweise for the tax return
You will still have chaotic mornings. What you should not have is a silent gap between “I stayed home with my kid” and “nobody paid me because the wrong law was on the form.”
